The Costa del Sol runs west from Málaga to the edge of Sotogrande, and new-build supply sits all along it. Marbella and Estepona hold much of the stock, but character and setting differ sharply. Marbella draws buyers to the Golden Mile, Puerto Banús and the Nueva Andalucía golf valley, where many schemes are apartments and penthouses in gated communities. Estepona offers beachfront developments and hillside villas west of the town, with a slower pace than Marbella and more villa-led supply. Benahavís sits inland above the coast, known for golf courses and mountain views, and the schemes there lean towards villas and townhouses rather than apartment blocks.
Mijas covers a large area from the coast at La Cala de Mijas up into the hills around Mijas Pueblo, so a scheme in Mijas can be beachside or several kilometres inland. Fuengirola and Benalmádena lie east of Mijas, closer to Málaga, and their new developments tend to be apartments in urbanisations near the town centres and beaches. Further west, Casares, Manilva and San Roque offer quieter settings and proximity to Sotogrande, often with frontline golf developments. Málaga itself, and Torremolinos to its west, hold a smaller share of new stock, usually apartment schemes aimed at year-round living rather than holiday use.
When you reserve off-plan, you pay in stages as construction progresses. Spanish law requires the developer to secure every payment you make before completion with a bank guarantee or insurance policy. That guarantee is your protection if the developer fails to deliver: the bank must return your money. Before you transfer any funds, ask to see proof that the guarantee is in place, and check it covers the full amount you are paying. The developer's brand matters less than that document.
A new development bought from a developer is subject to VAT and stamp duty, not the transfer tax a resale buyer pays. VAT applies to the purchase price, and stamp duty falls on the deed itself. The rates depend on the region and should be confirmed with your lawyer before you budget. Transfer tax does not apply to a new build sold by the developer, only to resale properties.
Completion timing depends on when the town hall signs the building off as fit to live in. The developer cannot hand over keys until that sign-off is granted, regardless of what the contract says. Delays in obtaining it are the most common reason a completion date moves, so build a margin into your plans if you need to be in the property by a fixed date. Once you have the keys, arrange a final inspection to list any unfinished work or defects. The developer is required to remedy those items, and Spanish law holds the builder liable for one year on finishes, three years on issues that affect living in the home such as damp or insulation, and ten years on structural defects.
If you are comparing off-plan with resale, the main difference is timing and condition. A resale property can complete within weeks and you can view the exact home you are buying, but the finish is whatever the previous owner left. An off-plan purchase means waiting for construction to finish, often a year or more, but you receive a new home with a warranty and no prior wear. Many buyers also choose off-plan for the ability to select finishes and layouts while the building is still being designed.
To assess a developer, look up the company behind the scheme at the land registry and check its history of delivered projects. A track record of completed developments in the area is a stronger indicator than marketing materials. Ask which town hall approvals are already in place and when the building permit was granted, because a scheme that has broken ground is further along than one still awaiting permits. The bank guarantee remains the essential safeguard, but doing that background check reduces the chance you reserve with a developer that cannot finish what it starts.
