Málaga's new development market sells almost entirely off-plan, with homes reserved before completion. Buying off-plan in Málaga means securing a home before the builder finishes it. The process works differently from buying a resale property, and understanding the mechanics matters before you reserve.
You pay in stages as construction progresses, not all at once. Spanish law requires the developer to secure every payment you make before completion with a bank guarantee or insurance policy. That guarantee protects your money if the developer fails to deliver, and you should confirm it exists before you transfer the first payment. Ask for the bank's written confirmation, not just the developer's promise.
VAT applies to new developments bought from a developer, set at ten percent on the purchase price. You also pay stamp duty on the purchase deed, at a rate that depends on the region and should be confirmed with your lawyer. Transfer tax does not apply to a new build bought this way. A resale buyer pays transfer tax instead of VAT, but that regime does not cover purchases direct from a developer.
Before the developer hands over keys, the town hall has to sign the building off as fit to live in. Only the town hall can issue that sign-off, and waiting for it is the usual reason a completion date moves. The developer cannot control the town hall's schedule, so treat any completion date as an estimate and plan your move with flexibility.
You inspect the property before completion to list any unfinished work or defects. The developer must address the items on that list, and you confirm they have done so before you accept the keys. Spanish law then holds the builder liable for one year on finishes, three years on issues that affect living in the home such as damp or insulation, and ten years on structural defects. Those periods run from handover, not from reservation.
Málaga's new supply concentrates in Málaga Este and Málaga Centro. Some schemes sit beachfront, others close to the beach, and many offer sea views even where they stand back from the shore. The town setting puts shops, schools and transport within reach, and some developments sit close to the marina or port.
Assess the developer before you reserve. Look up the company behind the scheme at the land registry to confirm it owns the land and check whether it has delivered other projects. A track record of completed developments tells you the firm knows how to finish what it starts, though the bank guarantee matters more than the brand. Even a household name cannot hand you your money back if it folds, but a bank guarantee written in your favour can.
Compare off-plan with resale before you decide which route suits you. A resale property exists and you can walk through it, measure the rooms and check the condition. An off-plan purchase offers a new home to your specification, often at a lower price than a comparable resale, but you wait for construction and you cannot see the finished result until handover. The tax treatment differs, the payment schedule differs, and the timeline differs. Both routes work, and the right choice depends on whether you value certainty or newness more.
